TERMS AND CONDITIONS
1.GENERAL
This document is valid without your signature. With the signed cost estimate you ensure to have read and understood the TERMS AND CONDITIONS of ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO. You guarantee that you have a valid liability insurance at the time of renting DEADLINE STUDIO. In the case of an accident involving you or one of your team members ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO is not liable. You guarantee that your team was informed about the TERMS AND CONDITIONS of ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO before renting and that all team members agree with it.
2.STUDIO HIRE
The object of the rental contract are the rooms mentioned in the rental contract with the agreed equipment and usage. The studio can be booked provisionally via Online Booking or E-mail. The booking should be confirmed within 48 hours. The hiring becomes legally binding with the signature of the lease (estimate confirmation), the paying of the online booking fee or with the signature on the booking form.
A booking option can be reserved only via E-mail and maximum 14 days.(FOUND AT OTHER STUDIOS: RESERVATION TIMES ONLY 2 DAYS) 10 days before a booking date the option can only be reserved for 2 days and has to be confirmed after that. 1st options can be hold for only a 24 hour-period as soon as a customer with a 2nd option is ready to confirm a booking.
If the customer wishes to postpone a confirmed booking, this must be done at least 3 days before the hire period starts or 50% of the full studio booking rate will apply. Only one reschedule will be allowed without adding any extra booking fee. With any additional rescheduling after that an extra rescheduling fee of 20% of total costs is due.
DEADLINE STUDIO is available for the exclusive use of the customer named in the booking. The customer is not permitted to sub-contract, sub-let or otherwise permit any third party to utilize DEADLINE STUDIO without the prior written consent of ONE HUNDRED BERLIN GmbH / DEADLINE STUDIO.
The tenant is hereby obliged to treat the property of ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO with care. The premises and equipment are considered to be in perfect condition, unless any defects are expressly criticized when they are taken over. The lessee must immediately notify DEADLINE STUDIO of any damage, defects or losses that occur during the rental period.
Any materials used in connection with sets, constructed by the customer, as well as any rubbish shall be removed from ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO at the end of the hire period at the expense of the customer otherwise additional charges will apply.
ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO is strictly a non-smoking area, which includes the use of fire, haze and smoke machines. If smoke alarms are set off a fine of minimum € 800,-? will be imposed.
IF THE POLICE (min. € 200,-) AND FIREFIGHTERS (min. € 400,-) ARE COMING AND IF IT IS A WRONG ALERT, WE WOULD HAVE TO PAY min. € 600,-
No alterations, decorations or additions to DEADLINE STUDIO are permitted without the consent of DEADLINE STUDIO. At the end of the hire period DEADLINE STUDIO must be surrendered in the same condition that it was in at the start of the hire period. The customer shall pay any costs incurred by DEADLINE STUDIO arising out of any breach of this condition.
3.HIRE OF PROPS & SERVICE
All equipment and services which are provided by DEADLINE STUDIO are entirely at the risk of the customer. The ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO shall not be liable for loss or damage of any kind to material or props or equipment entrusted to it however caused including consequential loss and loss of profit.
The customer must notify DEADLINE STUDIO at the time of supply if the condition of any equipment is not acceptable.
In no circumstances shall DEADLINE STUDIO be liable for any loss or damage, including consequential loss, however caused arising out of the use or the inability to use the equipment supplied or agreed to be supplied.
In case at the request of the customer DEADLINE STUDIO supplies to the customer the services of assistants, sub-contractors, freelancers or other persons such persons shall be deemed to be the servant of the customer and the said services shall be deemed to be rendered by the customer and DEADLINE STUDIO shall not be liable for loss or damage of any kind however caused.
DEADLINE STUDIO shall not be liable for any loss or damage howsoever arising out of any statement advice instruction or any other representation given or made by any servant of DEADLINE STUDIO or any other person whose services are supplied to the customer.
Equipment must be returned promptly at the end of the hire period in good condition (save for fair wear and tear). The customer shall pay or compensate DEADLINE STUDIO for the replacement value of lost or damaged equipment or in respect of any cancellation or variation of any order or failure to return the equipment on time.
4.WORKING HOURS
DEADLINE STUDIO is available for daily use of 9 hours between 9am to 18h00 o’clock, or 10am to 19h00 o’clock. Use outside these hours is not permitted unless previously agreed in writing to DEADLINE STUDIO/ MANAGER.
The premises must be left in their original condition at the end of the rental period, that includes all decorations, set constructions, etc. exceptions require the written permission of DEADLINE STUDIO.
5.OVERTIMES
Bookings may only be extended with the prior consent of ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO, overtime rate of €85/ h will be applicable to hires that run over the booked time. Every started hour will be counted as a full hour and will be charged.
€ 50,- charge for breakfast served at 8:30 am
€ 85,- charge for breakfast served at 8:00 am
€ 100,- charge for breakfast served at 7:30 am
€ 80,- charge per day on WEEKEND/PUBLIC HOLIDAYS
6.CONTENTS
The tenant is prohibited from producing insulting, defamatory, anti-constitutional, racist, sexist, homophobic, violence-glorifying or pornographic content in the rooms of ONE HUNDRED BERLIN GmbH/ DEADLINE STUDIO.
7.CANCELLATION
The tenant can withdraw from the rental contract free of charge up to seven days before the rental date. From the period from seven days to 48 hours before the rental date, 50% of the 100% booking costs must be paid or will not be refunded.
If the 48 hours are exceeded to the actual rental date, then 75% of all booking costs will be incurred. From the point of cancellation of 24 hours before the start of the rental period, the full rent (100 % of booking + MwSt. 19%) and all other costs incurred by expenses for DEADLINE STUDIO must be paid. If the customer has already made a deposit, it will not be refunded in case of a cancellation and the missing 50% plus 19% taxes are due.. Exceptional reasons of cancellations can be accepted, but only if the cause wasn’t known before the booking and just with solid documents, which has to be sent to the DEADLINE STUDIO/ MANAGER without being asked.
These conditions are valid for a contract termination, not for rescheduling (2. STUDIO HIRE).
8.LIABILITY
DEADLINE STUDIO internet connection is included in the rent. No illegal download of copyrighted images, movies, music, software, etc. For any resulting damage DEADLINE STUDIO is not liable.
The lessor is liable only for intent and gross negligence of its legal representatives or vicarious agents, in case of slight negligence only in case of breach of essential contractual obligations. This also applies to loss or damage of digital data in cameras and / or image recording and / or processing equipment. These limitations of liability do not apply to injury to the body, life or health. The strict liability of the landlord is excluded. Insofar as the contractual obligation refers to defects which already existed at the time of conclusion of the contract or upon delivery of the rental object, the lessor is not liable for slight negligence, without prejudice to the above provision.
The landlord is not liable for objects brought in by the lessee, his agents or other persons involved in the production. The landlord ensures proper supply of the rooms with electricity, water, heating and the booked equipment. However, it is not liable for damages that arise in connection with exceptional weather conditions, in particular by storms, that cause an interruption. Insofar as faults or interruptions are caused by the electricity supplier or water supplier or supplier with heating energy, the renter's claims are limited to the assignment of the lessee's claims against the relevant service provider. The landlord is also not liable for damage caused by voltage drop or voltage changes.For damage and loss of the rental object and the building, the associated facilities, equipment, property damage and personal injury, including any consequential damage, the lessee is liable for compensation, as far as this damage caused by him or the persons belonging to its production or by third parties culpably.
The renter is obliged to take out sufficient liability insurance to cover the aforementioned risks and to prove this to the landlord upon request. The lessee releases the landlord from all claims for damages that are asserted against the landlord by third parties in connection with the production.
9.INDEMNITY
The customer shall at all times keep DEADLINE STUDIO indemnified against all actions proceedings costs charges claims expenses and demands whatsoever which may be made or brought against DEADLINE STUDIO or the servants or agents of DEADLINE STUDIO by any third party in respect of any alleged injury loss damage or expense arising out of or in connection with the use of DEADLINE STUDIO or equipment or services supplied by DEADLINE STUDIO even where such injury loss damage or expense is caused wholly or in part by the negligence or breach of contract of DEADLINE STUDIO its directors, servants or agents save in respect of any death or personal injury caused by the negligence of DEADLINE STUDIO as aforesaid.
10.PAYMENT
10.1.PAYMENT VIA KVA
After we received the signed COST ESTIMATE the customer agree with the TERMS AND CONDITIONS of ONE HUNDRED BERLIN GmbH / DEADLINE STUDIO. The estimate is a NETTO invoice and 50% of total estimate is due at least seven days before the date of hire. Only after receiving the 50% of total estimate we can confirm the booking as soon as possible. DEADLINE STUDIO cannot guarantee that the date of wish is still available.
After the hiring the customer will receive an invoice with the other 50 % of total estimate plus all additional costs, if there are any (e.g.: props, overtimes and more). Additionally, the invoice comes with 19 % taxes.
10.2.PAYMENT VIA BOOKING SYSTEM ON WEBSITE
For booking via the website of DEADLINE STUDIO, 50% of NETTO costs are due immediately. The customer chooses between different payment methods: Credit Card, PayPal or Lastschrift. After the booking we will confirm as soon as possible. After the hiring the customer will receive an invoice with the other 50 % of total estimate plus all additional costs, if there are any (e.g.: more beverage packs, overtimes and more). Additionally the invoice comes with 19 % taxes.
11.USAGE
For purposes of self-promotion, the tenant allows DEADLINE STUDIO to take and use photos of the set constructed by the tenant. If the tenant wishes to refrain from doing so, DEADLINE STUDIO should be informed by E-Mail/ written consent. No persons belonging to the production of the tenant will be photographed, unless this was approved by the tenant by E-Mail/ written consent.
12.PARKING AND DELIVERY
For insurance reasons, parking in the yard is not permitted. Vehicles can drive into the 1st courtyard for loading and unloading. For finding a near parking lot DEADLINE STUDIO is not responsible. Cheap Parking is in general complicated in Berlin but there are PARK+RIDE options, please sent a request to our studio manager, we will find a solution.
13.JURISDICTION / SEVERABILITY CLAUSE
Changes and additions to the rental contract and the general rental conditions must be in written consent with DEADLINE. This also applies to changes to this written form clause. Verbal side agreements are not valid. German law applies. As far as legally permissible, the place of jurisdiction is Berlin. Should individual provisions of this contract be or become invalid, this does not affect the effectiveness of the other contract components. The contract parties undertake to replace the ineffective provision by an effective one that comes as close as possible to the legal and economic purpose of the ineffective one. This applies accordingly to gaps in the regulations of the Terms of Hire by DEADLINE STUDIO.
